Reporting copyright infringement and our takedown process.

Effective September 1, 2025

postlii.ca respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), specifically 17 U.S.C. § 512, postlii.ca has adopted the following policy and procedures to respond to legitimate claims of copyright infringement submitted in accordance with the law.

1. General Policy

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement and is accessible via postlii.ca, you may submit a formal DMCA takedown request. postlii.ca will promptly investigate and, if required, remove or disable access to the allegedly infringing content.

We do not accept or process DMCA complaints through postal mail or phone. All DMCA notices and counter-notices must be submitted via email to: info@postlii.ca.

2. DMCA Takedown Notice — Required Elements

To submit a valid DMCA notice, you must provide a written communication (email only) that includes the following:

  • Identification of the copyrighted work that you claim has been infringed, or a list of copyrighted works at the site if multiple works are involved.
  • Identification of the material that is claimed to be infringing, with specific reference to its location (URL or exact page) on postlii.ca, so that we may locate it and assess the claim.
  • Your full contact information, including your name, mailing address, telephone number, and email address.
  • A clear statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information provided in your notice is accurate, and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature, which can be typed or scanned.

Important

Incomplete notices or notices that do not meet the above requirements may not receive a response.

3. postlii.ca's Response to DMCA Notices

Upon receiving a proper DMCA notice, we will acknowledge receipt of the complaint via email, review the contents and verify whether the material appears to be infringing, remove or disable access to the content if the claim is deemed valid, and notify the account holder (if applicable) whose content was removed.

We will not disclose the identity of the complainant to the accused user unless legally required to do so. However, the accused will be informed of the substance of the complaint.

Please be aware that there are legal consequences, including penalties and damages, for knowingly submitting false claims of copyright infringement.

4. Submitting a DMCA Counter-Notice

If you are a user of postlii.ca and believe that your content was removed or disabled in error or due to misidentification, you may file a counter-notice. A valid counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location of the material before it was removed
  • A statement under penalty of perjury that you have a good faith belief that the removal or disabling of the material was a mistake or misidentification
  • Your full contact information, including your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located, or, if outside the United States, that you consent to the jurisdiction of any judicial district in which postlii.ca may be found, and that you will accept service of process from the party who submitted the DMCA complaint

5. Repeat Infringers

Users who receive multiple valid DMCA complaints may be subject to account suspension or permanent termination, blocking of future access to paid content, and reporting to legal authorities when appropriate.

We take copyright protection seriously and will act to ensure the integrity and legal compliance of our platform.

6. Legal Notes and False Claims

Filing a false DMCA notice or counter-notice may subject you to legal liability, including damages and attorneys' fees, under Section 512(f) of the DMCA.

If you are unsure whether material you are reporting or defending is protected by copyright or whether your use constitutes fair use, please consult with a qualified attorney before submitting a claim.
